Call to Order:  The meeting was called to order in the Panton Town offices at 7:05 p.m. by S. Hofmann, Chair. A quorum was established.

Minutes:   Motion by R. Moulton seconded by A. Tisbert to approve the minutes of the August 4th, 2005 meeting with the following changes that L. Giovannella proposed:  page 2 first paragraph change there is no evidence as to what was done with the plan to the following:  Ed Hanson found no evidence as to what was done with this plan.  Also on page 2 second paragraph change there was no evidence as to what decision was made at that hearing with respect to this plan to the following:  Ed Hanson stated he found no evidence in any minutes as to what decision was made at that hearing with respect to this plan.  So voted unanimously.

Public Communication: D. Boyle asked if they needed to attend every monthly meeting concerning changes to zoning pertaining to the Cooke property, on Route 22A which was talked about at the August 4th meeting.   S. Hofmann stated they did not and the process for a zoning change would take many months.  R. Moulton stated it would not only be their property but a whole district that would have to be changed, as E. Hanson had explained in the August meeting.   Discussion about the process and steps involved in getting change was explained.

Old Business Hearing:   S. Hofmann explained the steps taking during the Hartenstein hearing concerning all packets and letters sent out to members of the board and the four participants at the hearing.  S. Hofmann thanked everyone who took part is the hearing process.  Concern for the budget was mentioned by S. Hofmann as to the expense incurred due to the hearing.

S. Hofmann stated that E. Hanson could not attend tonight’s meeting but had brought him up to speed on the Bushey property which has been turned over to town council.  Also Mr. Hanson has started reviewing Whispering Pine Campground.  The last indications are that there are 22 permanent residents living in temporary seasonal housing.  Further discussion on the septic system and zoning permits issued for Whispering Pines continued. E. Hanson will continue to investigate.

Zoning Regulations:   Review of zoning regulations was discussed.  S. Hoffmann stated it was time once again to review the entire package.  Discussion as to when it was last done occurred.  The definition of abutting land owner is one item that needs to be addressed.   S. Hofmann suggested that everyone should review the documents he will be mailing to members and make notes for future meetings for change in the zoning regulations.  R. Moulton reminded the board that members need to speak one at a time if all want accurate minutes transcribed.  S. Hoffman reminded the board that once the board becomes a DRB everyone would need to identify themselves to speak.  L. Giovanella stated she thought it had been decided that the applicant would be responsible to notify the abutting land owners.  S. Hofmann explained some of the issues with doing this.  M. Hermann went on record stating that the town had always provided early notification to the abutters, it was done informally but that it reduced  problems by allowing the property owners who are contiguous to make their concerns known early on.  Abutting land owner definition continued.  S. Hofmann advised that this was just one item that needs to be worked on.

S. Hoffman advised that the Selectboard had not worked on the appointment to ACRPC but it was on their adjenda for Monday night.  L. Giovanella asked about the procedure for notifying the Selectboard on motions the planning/zoning board sends forward to the Selectboard.  S. Hoffman explained that he sends forward any discussing that is pertinent to them.  S. Hoffman went on to say just for clarification purposes the Selectboard has final say over all appointments in the town.  The planning/zoning board can make suggestions but it is the Selectboards final decision.  S. Hoffman explained the steps to bring items to the Selectboard for attention and how it is handled.  He also noted that all planning/zoning minutes are forwarded to Selectboard members. 

Comments by board members:  Suggestion was made that meetings for revisions to zoning regulations be separate from regular monthly meeting.

The next meeting will be October 6, 2005 @ 7:00 P.M.
Motion to adjourn at 8:04 by R. Moulton seconded by A. Tisbert.  So voted.
